1. General points

4. Payment

5. Delivery

5.1 We will make our best effort to deliver you the goods to the provided address during the order as long as the delivery address is in one of the following countries: Belgium, Luxembourg, France, Germany, Italy, Netherlands, Spain and UK

5.2 Once the order is made, you will receive an email confirming your order. As soon as your order is ready to be shipped, you will receive an email confirming the shipment.

5.3 Delivery dates are approximate and not guaranteed. We will do our best to keep you informed of any delays in delivery, but we disclaim, to the extent permitted by applicable law, any liability for losses, liabilities, costs, damages, consequential costs or expenses or not a delay delivery.

7.2 Withdrawal and return policy of EVOK SHOES
Without prejudice to your withdrawal rights and return as provided by law and described above in Section 7.1, we offer a flexible return policy, by accepting the return of any item that is returned to us within 28 calendar days after delivery, as described in sections 7.3 and 7.4 below. 7.3 Goods conditions
Please handle and examine the delivered items in the same way that you would be allowed to do in a store (thus providing the necessary care) until you decide to keep them. All items must be returned unused, complete in their original packaging. We will check the goods condition that will be returned. 7.4.3 Packaging
When you return an item, please: Put the item in its original packaging and ensure its protection in a cardboard packaging. Close and sealed it by an adhesive tape adapted to the box. Fill in the fields of pre-printed return label sent in the original package and stick it on the return package. If you have lost this return label, you can print a new label from your account. For this, you should provide the order number as indicated on the invoice. You can also call our customer service which will send you a new label to return by mail or fax. For UPS: please ensure that the UPS driver/deliverer indicates its name in full and sign the part of your return label that you carefully must keep. This signature is proof that UPS has taken over your items. You can track your return through the UPS tracking number printed on the label.

7.5 Refund
If you use your withdrawal right, we will immediately refund and no later than 14 days after receiving your withdrawal notice. However, the refund will be initiated upon receipt of returned items or proof of sending your items, if the latter was received previously. We will refund the purchase price paid for returned items and shipping costs as well on the basis of a standard mail as we have sent you (i.e. no reimbursement of additional costs of shipping compared to standard delivery). Any partial return of an order does not involve the refund of the original shipping cost. The refund will be done according to the same method of payment. Subject to your agreement, we will refund by any other process.

8. Item exchange

It is currently not possible to exchange an item. However, you can return your item (see section 7 above) and place a new order from your shop Evok account.

9. Warranties, return of defective or non-compliant goods

9.1 As a consumer, you have the legal guarantee on the items you purchase on our website. None of the specified provisions can affect this warranty. Our items are delivered free from defects and be free of defects in materials or workmanship, except minor defects, with the features indicated on our site: the delivered items will be deemed to comply with features and properties described or detailed on our website, during a normal use.

9.2 If the item received is defective or does not comply with your order, you must report it as quickly and in any case no later than within two (2) months of the defect occurrence. 10. Governing law
These Terms and any contract hereunder and any litigation relating thereto (including their validity) or resulting from a purchase or use of the website shall be governed by the French laws, which courts hold exclusive jurisdiction.

11. Order retention
We do not save the email confirmation of your order or its details. We recommend you to save it for your own reference.

12. Email
When you visit our site or you send us emails, an electronic communication is made with us. You agree, for contractual purposes, to receive electronic communications from us and you agree that all agreements, notices, disclosures and other communications that we send you electronically have legally value of written communication.

13. Confidentiality

15.3 We will not be held responsible for delays or breach of our obligations if the cause of that delay or failure is beyond our reasonable control ("Force Majeure").
